Art. 1 General

  • This is the privacy policy for UVITY, the business platform for engineers and IT specialists (cf. Art. 1 (1) of the Terms of Use). With this privacy policy, we would like to inform you which personal data we collect from you and how we process it when you visit and use the UVITY Internet platform.
  • With your consent to this privacy policy as required for registration on UVITY, you consent to the collection, processing and use of your personal data as described below in the context of the establishment, performance and settlement of your user relationship with regard to UVITY.
  • “Personal data” as defined in the General Data Protection Regulation (GDPR) is all information relating to an identified or identifiable natural person. A natural person is considered to be identifiable when he or she can be identified either directly or indirectly by means of reference to an identifier such as a name, identification number, location data, an online identifier or to one or more specific factors relating to the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person. Put differently, your personal data is information that relates to you or says something about your person and can be associated with you, either by itself or in combination with other information. For reasons of simplicity and clarity, this privacy policy may also refer to “your data” only in relation to your personal data.
  • We take the protection of your data seriously, and this protection can only be provided if you know what happens with your data on UVITY. This is why we ask you to take the time to read this privacy policy carefully. We comply strictly with applicable data protection regulations and have taken both technical and organisational measures to protect your data.
  • In no event will we disclose your personal data to third parties for advertising or marketing purposes or release it to third parties for any other purposes without authorisation.
  • Only persons who have reached the age of majority may register with and use UVITY. Minors may not register with or use UVITY.

Art. 2 Registration and collection, processing and use of data

  • Required information

    • UVITY collects certain required information (in the following “required information”) for the registration with and use of UVITY as a member.

    • During the registration process as a Classic, Professional or Corporate member, you are asked for your first and family name, an e-mail address associated with you and a password. Information on your payment method is only collected if you register as a Professional or Corporate member.

    • During the registration process as a Corporate member, we collect the name of your company or partnership, or the company or partnership represented by you respectively. Other required information is the VAT identification number, invoice address and a payment method for your company or partnership or the company or partnership represented by you respectively.

    • Your password, e-mail address and payment method are not accessible to other persons (neither non-registered visitors nor registered members). We will not pass it on to third parties either, unless we are legally obliged to do so in exceptional cases.

    • We use your e-mail address and your name to contact you. You can change your password at any time via your profile (definition see Art. 2(3)(a) of this privacy policy). You can change the name of your company or the company you represent or the organisation you represent at any time via your microsite (definition see Art. 2(3)(a) of this privacy policy).

    • The above data (required data) is necessary for you to be able to use the UVITY services. This data is therefore collected and processed based on Art. 6(1)(b) GDPR. This data is stored for the period during which you have a user account with UVITY (in the following “ACCOUNT”). Once you delete your ACCOUNT, this data is no longer stored, unless its processing is necessary in order to meet our legal requirements under Art. 6(1)(c) GDPR or to pursue our legitimate interests according to Art. 6(1)(f) GDPR.
  • Voluntary information

    • You may provide additional voluntary information (in the following “voluntary information”). This may include, for example, information about your location (city and country), your professional career, the company or partnership you represent, or your professional category. You may also upload a portrait photo or other contents to your Website (for definition see Art. 2(3)(a) of this privacy policy). You can change or delete your voluntary information at any time.
    • This type of data (voluntary information) is voluntary but supports the use of the UVITY services. This data is therefore collected and processed based on Art. 6(1)(a) GDPR. This data is stored for the period during which you have an ACCOUNT with UVITY. This data is no longer stored if you delete your ACCOUNT.
  • Your website

    • You agree that, upon completion of your registration under your name, a website for the presentation of your own person (hereinafter referred to as "PROFILE") or a website for the presentation of your own organisation (hereinafter referred to as "BUSINESS SITE") will be set up for you under the company or partnership you represent, on which any voluntary information you may provide will be listed and on which any content you may upload will be displayed.

    • You further agree that you may be found under your name or that of the company you repre-sent or that of the partnership you represent via the UVITY search function (hereinafter referred to as "SEARCH") and that your website may be viewed by other persons (non-registered visitors and registered members) (platform visibility).

    • You agree that you may be found under your name or the name of the company you represent or the name of the partnership you represent by anyone via search engines on the Internet (internet visibility).

    • After completing the registration, you can publish content on your website. You agree that the content you publish on your website will be visible to all visitors by default. You can edit the content you publish on your website at any time, make it invisible to others or delete it.

    • You also agree to be displayed as a logged in UVITY member when visiting websites of other UVITY members, as a person with your portrait photo, your first and last name, your position and your location (city and country).
    • This data is therefore collected and processed based on your consent according to Art. 6(1)(a) GDPR as far as the voluntary information and any contents you may have uploaded are concerned. This data is stored for the period during which you have an ACCOUNT and your website is maintained under this ACCOUNT. This data is no longer stored if you delete your ACCOUNT.
  • Server log files

    • Every time you call up an internet site on the World Wide Web, your browser automatically sends certain information to the relevant internet page server, which then stores this information in a so-called log file. This information may include data on:

      • the type and version of the browser you use;
      • the operating system you use;
      • the internet page from which you visited the current page;
      • your computer’s host name (IP address) and
      • the time at which the page was visited.
    • We delete or anonymise your IP address once you have left the UVITY internet pages, subject to any applicable legal storage obligations.

    • Otherwise we use the information provided to our servers via your browser in anonymised form to analyse and improve our services. This process does not allow any conclusions being drawn regarding your person. This allows us to detect potential errors and analyse on which days and at what times UVITY is being used most intensively, for example.

  • Cookies

    • Similar to many other websites, we also use so-called “cookies”. Cookies are very small text files that are used by internet pages and stored on your computer by your browser. So-called “session cookies” are stored temporarily in your computer’s working memory and deleted automatically when the browser is closed. So-called “permanent cookies” are stored on your hard drive for a predefined, longer period and automatically deleted once the relevant, defined period has expired.

    • Cookies mainly serve to make using internet pages easier, more effective and more secure. We use cookies to be able to identify you throughout your session once you have logged on to UVITY. The relevant session cookie automatically expires at the end of your session.

    • You can set your browser to reject all cookies or to accept them only following your express confirmation. Use your browser’s help function to find out how to do this easily. However, if your browser is set to reject cookies, you may only be able to access a limited range of UVITY functionalities or not be able to access them at all.

  • Matomo

    • This website uses the web analytics service Matomo to allow us to analyse the usage of our website and improve the site on an ongoing basis. Based on the statistics obtained from this service, we are able to improve our offering and make it more attractive for you as a user. The legal basis for using Matomo is Art. 6(1)(1)(a) and (f) GDPR.
    • This analytics service involves the storage of cookies on your computer (see also the information provided under No. 5 above in this regard). The data controller stores the data collected in this manner exclusively on its server in Germany. You may prevent these analytics by deleting existing cookies and blocking the storage of new cookies. Please note that, if you block cookies from being stored, you may not be able to access the full range of functionalities provided by this website. You can block your computer from storing cookies by making the relevant settings in your browser.
    • This website uses Matomo with the extension “AnonymizeIP”, causing IP addresses to be processed in truncated form, which ensures that they cannot be directly related to any individual person. The IP address transmitted by your browser via Matomo will not be aggregated with other data collected by us.
    • The Matomo software is an open-source project. Please visit https://matomo.org/privacy-policy/ for more information about this third party’s privacy policy.
  • Google Analytics

    • This website uses Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses cookies (see also the information provided under No. 5 above in this regard). The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. However, if IP anonymisation is activated on this website, your IP address will be truncated by Google in advance within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA where it will be shortened. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services relating to website activity and internet usage to the website operator.

    • The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

    • You can prevent the storage of cookies by making the appropriate settings in your browser software; however, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent. You can also prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address) and Google from processing this data by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

    • This website uses Google Analytics with the extension “_anonymizeIp()”, causing IP addresses to be processed in truncated form, which ensures that they cannot be related to any individual person. To the extent that the data collected about you can be associated with you as a person, this association is therefore immediately excluded, and the relevant personal data consequently erased.

    • We use Google Analytics to allow us to analyse the usage of our website and improve the site on an ongoing basis. Based on the statistics obtained from this service, we are able to improve our offering and make it more attractive for you as a user. Google has declared itself subject to the EU-US Privacy Shield (https://www.privacyshield.gov/EU-US-Framework) for the exceptional cases in which personal data is transmitted to the USA. The legal basis for using Google Analytics is Art. 6(1)(1)(a) and (f) GDPR.

  • Google remarketing

    • This website uses Google’s remarketing function, which serves to present website visitors with interest-based advertising within the Google advertising network.

    • A cookie (see also the information under No. 5 above in this regard) is stored in the website visitor’s browser for this purpose, allowing the visitor to be recognised if they view web pages that belong to Google’s advertising network. On these pages, visitors may be presented with advertising that relates to contents which they have accessed earlier on websites that use the Google remarketing function.

    • c) According to Google’s own information, Google does not collect personal information as part of this process.

  • Google AdWords

    • Our website uses Google AdWords’ conversion tracking. If you access our website via an advertisement placed by Google, Google AdWords stores a cookie on your computer.

    • The conversion tracking cookie is stored when a user clicks on an advertisement placed by Google. These cookies only remain valid for a period of 30 days and do not serve personal identification purposes.

    • If a user accesses certain pages on our website while the cookie is still active, we and Google are able to see that they have clicked on the ad and were redirected to this page. Each Google AdWords customer receives a different cookie.

    • Cookies can therefore not be traced via the websites of AdWords customers. The information collected using the conversion cookie serves to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers are informed about the total number of users who have clicked on their ad and were directed to a page featuring a conversion tracking tag. However, they are not provided with any information that would allow users to be personally identified.

  • LinkedIn

    • Our website uses LinkedIn’s conversion tracking. LinkedIn’s conversion tracking is an analytics service of LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. A conversion tracking cookie is set on your computer if you click on an ad placed by LinkedIn.

    • These cookies only remain valid for a period of 30 days. They do not contain personal data and therefore do not serve personal identification purposes. If you access certain pages on our website while the cookie is still active, we and Google are able to see that you have clicked on the ad and were redirected to this page. Each Google AdWords customer receives a different cookie. Cookies can therefore not be traced via the websites of AdWords customers.

    • The information collected via these cookies serves to generate conversion statistics for LinkedIn customers who have opted for conversion tracking. In this case, customers are informed about the total number of users who have clicked on their ad and were directed to a page featuring a LinkedIn-Insight tag. However, they are not provided with any information that would allow users to be personally identified.

  • CloudSponge

    • This website uses CloudSponge, an address book processing service of Cloud Copy, Inc. ("Cloud Copy"). We only provide Cloud Copy with the information necessary to provide the service. We also contractually require Cloud Copy to keep confidential all information we share with Cloud Copy and to process your personal information only in accordance with our instructions. If you choose to provide us with your address book information, you will have access to the address book information we collect through the software. This usually includes names, email addresses, phone numbers and other contact information that concerns you and members of your social circle.
    • We only use this data in our company and never pass it on to third parties. We track the following events and data points:
      • If you select a source
      • If you have successfully connected your address book and how many entries it contains
      • If you want to share your contacts and how many contacts you have shared
      • When you close the widget without sharing contacts
      • If an error occurred while connecting your address book
    • The legal basis for the use of CloudSponge is Art. 6(1)(1)(a) and (f) GDPR.
  • Stripe

    • This website uses an e-commerce and payment transfer service provided by Stripe, Inc., 510 Townsend Street, San Francisco, CA 94103 (USA). We only provide Stripe with the information necessary for the service offered:
      • cardholder name
      • email address
      • unique customer identifier
      • order ID
      • bank account details
      • payment card details
      • card expiration date
      • CVC code
      • date/time/amount of transaction
      • merchant name/ID
      • location
    • The legal basis for the use of Stripe is Art. 6(1)(1)(a) and (f) GDPR.
  • Social plugins

    • We offer the optional use of so-called “social media buttons” on our website. We use the Shariff application to protect your data in implementing this option.

    • This means that social media buttons on the website are merely provided as graphics containing links to the relevant b utton operator’s website. As a result, you are directed to the relevant service provider’s page when you click on the button.

    • Your data is only sent to the relevant provider at that time, and there is no exchange whatsoever between you and the service providers represented by these social media buttons, unless you click on these graphics.

    • Please refer to the respective service providers’ terms of use for information about the collection and use of your data in these social networks. Our website features social media buttons of the following companies:

Art. 3 Your rights to information, correction, blocking, deletion and withdrawal against the processing of your data

  • You may first request information from us as to whether personal data relating to you is being processed. If this is the case, you have the right to information about this personal data and further information. This information includes the processing purposes, the categories of personal data, the recipients or categories of recipients, if possible, the planned duration of the processing or, otherwise, at least the criteria for determining that duration. In addition, you have the right to know that you have the right of rectification, deletion of personal data concerning you, limitation of the processing, opposition to the processing and the right to appeal to a supervisory authority.
  • If we do not collect personal information directly from you, you have a right to all available information about the source of the data.
  • A copy of your personal data which we process will be made available to you free of charge. Should you request further copies, an appropriate fee will be charged for each additional copy in the amount of the administrative costs.
  • You may withdraw your consent to the collection, processing and use of your personal data which you have given us with your consent to these data protection provisions in whole or in part with effect for the future. The same applies to any subsequent, further consent to the collection, processing or use of your personal data. As a result of such withdrawal, you may no longer be able to use UVITY or only be able to use it to a limited extent
  • You may also request the correction of any inaccurate data at any time, including the completion of any incomplete data, taking into account the purposes of processing. In addition, you may also exercise your right to cancellation or demand that the processing be restricted. You can delete your data yourself at any time. Either by cancelling your membership or by manually deleting your contents.
  • You also have a right to data transfer. This means that upon request you will receive from us the personal data that you have provided to us in a structured, common and machine-readable format. You have the right to transfer this data to another responsible person without any hindrance on our part.
  • You have the right to object to data processing and to appeal to a supervisory authority.
  • If and to the extent, however, that legal rights or obligations to retain data exist, we shall block the corresponding data for further use.

Art. 4 Changes to the privacy policy

  • This is version 2.0 of the privacy policy for UVITY.
  • We are constantly developing UVITY in order to provide you with an ever better service. We will always keep this privacy policy up to date and adapt it accordingly if and to the extent necessary.
  • We will notify you by e-mail of any changes to this privacy policy. Insofar we may refer to the regulations in Art. 3 of the Terms of Use. If, in addition, further consent from you should become necessary for our handling of your data, we will of course obtain it from you before corresponding changes take effect.
  • You can access the current version of the UVITY privacy policy at any time on the Internet at www.uvity.com/privacy abrufen.

Art. 5 Transmission or transfer of your data to third parties

  • We do not transfer your data to third parties without your consent.
  • However, a technical transfer may take place if and to the extent necessary for the operation of UVITY or for other reasons for the establishment, performance or settlement of your usage relationship with us. This may be the case, for example, in the case of Art. 2(12) or if UVITY is hosted by an external service provider, i.e. an external service provider operates the servers for UVITY. If this is not order processing, the transfer is based on Art. 6(1)(b) GDPR.
  • In addition, we may be required by law to disclose data in individual cases by order of a responsible authority if and to the extent necessary for the purposes of criminal prosecution, for the defence against dangers by the police authorities of the states, for the fulfilment of the statutory duties of the constitutional protection authorities of the Federation and the states, the Federal Intelligence Service or the Military Counter-Intelligence Service or the Federal Criminal Police Office within the scope of its duties to defend against the dangers of international terrorism or to enforce intellectual property rights.

Art. 6 Protection of your data

  • In order to protect your data from manipulation, loss and unauthorized access by third parties, for example, we use technical and organizational measures to ensure an appropriate level of protection for your personal data. These measures include the use of firewalls and anti-virus programs as well as manual security precautions. We continuously review and improve our security measures in accordance with the latest state of the art.

  • The data controller within the meaning of Art. 4(7) GDPR is Uvity s.r.o.. Comprehensive information about Uvity s.r.o., including its address and commercial register data, is available from our legal information at www.uvity.com/imprint.
